This will done by ensuring that the following steps are complied with.
1. Establish if misconduct was committed.
2. Draw distinction between misconduct and incapacity
3. Establish whether charges are drawn from the disciplinary code or common law.
4. Establish whether employee was notified timorously and afforded the right to be represented.
5. Establish whether investigations were conducted.
6. Establish whether there is evidence, and it is relevant and admissible.
7. Establish if there is material evidence be it, oral, documentary, real or in video.
